GENERAL INFORMATION

I. Privacy Policy:

The privacy policy (“Policy”) defines the rules for processing the personal data of the users of www.rigbyjs.com (“Users” and “Website,” respectively)

II. Data Controller:

The controller of personal data collected through the Website is Rigby spółka z o. o. based in Rzeszow (address: al. Tadeusza Rejtana 20A, 35-310 Rzeszow; registration: District Court in Rzeszow, KRS number: 750952; VAT ID: 7952550800; share capital: PLN 6,000.00; email address: hello@rigbyjs.com; “Controller”)

DATA PROCESSING

I. Type of data, purpose, and legal basis for their processing:

II. Duration of processing and storage of personal data:

  1. Data is processed as long as necessary to achieve the purposes indicated in the table above.
  2. Other data, if processed based on consent, are processed until the withdrawal of consent for their processing or until the purposes of processing are exhausted (the earlier date applies). Consent to process personal data can be withdrawn at any time, e.g., via hello@rigbyjs.com. Withdrawal of consent does not affect the legality of the processing carried out before the withdrawal of consent.
  3. Data required for the fulfillment of the Controller’s legally justified interests are processed only as long as necessary for the intended purposes or until an objection to further processing is raised. III. Obligation to provide personal data:

The User is not obliged to provide personal data to the Controller. Failure to provide data may result in the inability to obtain a response to a query or an offer regarding the Controller’s services.

IV. Rights related to the processing of personal data:

  1. The User has the right to access their personal data, including the right to obtain confirmation of whether they are being processed, and if so, the right to access them and to receive a copy of the personal data being processed.
  2. The User has the right to rectify personal data, including the right to request the Controller to immediately correct any inaccurate personal data.
  3. The User has the right to delete personal data.
  4. The User has the right to restrict the processing of personal data.
  5. The User has the right to data portability, including the right to receive the data and transfer them to another controller or, if technically feasible, to have the data transmitted directly to another controller – in cases where data are processed on the basis of consent in an automated manner.
  6. The User has the right to object to the processing of personal data in cases where data are processed for purposes resulting from legally justified interests pursued by the Controller under Article 6(1)(f) GDPR, unless the Controller can demonstrate (i) significant legally justified reasons for processing, overriding the interests, rights, and freedoms of the User or (ii) grounds for establishing, pursuing, or defending claims.
  7. The User has the right to lodge a complaint with the data protection supervisory authority – the President of the Personal Data Protection Office – if they believe that the processing of data violates legal regulations.

V. Exercise of rights:

  1. Every User has the right to contact the Controller with a request concerning the exercise of the rights indicated in Section IV of this Policy. Requests will be processed in accordance with GDPR regulations, including the right to verify the User’s identity.
  2. Requests should be submitted, e.g., by writing to hello@rigbyjs.com or sending it to the Controller’s registered address.
  3. If the Controller does not process the User’s data (excluding processing personal data for the request itself), the User will be promptly informed, and their data will be immediately deleted.
  4. Immediately upon receipt of the request, the Controller will inform the User and record the relevant information in its registry.
  5. Generally, the Controller addresses the request to the User immediately, no later than within one (1) month from the date of receiving the appropriate request. Due to the complex nature of the request or the number of requests, the term may be extended to two (2) months, of which the User will be immediately informed.

FINAL PROVISIONS

  1. All incidents affecting the security of Users’ personal data in the context of using the Website should be reported to hello@rigbyjs.com or sent to the Controller’s registered address.
  2. The Controller reserves the right to disclose selected information or personal data of the User to appropriate authorities or third parties who request such information/data on a legal basis and in accordance with applicable laws.
  3. Except in cases specified in this Policy, personal data will not be disclosed to any third party or authority without the consent of the data subject.
